Welcome to the website of Northern Estates North, LLC d/b/a Aspire Communities (“Aspire Communities,” “we,” “us,” or “our”), located at https://aspire-communities.com (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of our Site and related services. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
  • Use the Site to transmit any advertising or promotional material without our prior written consent, including any spam, junk mail, or chain letters
  • Impersonate or attempt to impersonate Aspire Communities, an Aspire Communities employee, another user, or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site
  • Use any robot, spider, or other automated device or process to access the Site for any purpose

2. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, photographs, audio and video clips, and software, is the property of Aspire Communities or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content on our Site without our prior written consent, except as permitted by applicable law.

3. User Submissions

When you submit information through our Site (including through our contact form, inquiry forms, or any other method), you represent and warrant that:

  • The information you provide is accurate, current, and complete
  • You have the right to provide such information
  • Your submission does not violate any applicable law, regulation, or third-party rights

Any information you submit through the Site will be handled in accordance with our Privacy Policy.

4. SMS/Text Messaging Terms

Aspire Communities offers an SMS messaging program for customer care purposes. By providing your mobile phone number and opting in to receive text messages from us, you agree to the following terms:

Opt-In and Consent

By texting our Customer Care number (616) 747-8283, texting START or JOIN to our Customer Care number, or by otherwise expressly consenting to receive text messages from us, you agree to receive recurring SMS messages from Aspire Communities related to customer care, including but not limited to: responses to your inquiries, appointment confirmations and reminders, maintenance updates, community notices, and other service-related communications.

Your consent to receive SMS messages is not required as a condition of purchasing any property, goods, or services from us. You may choose not to opt in and still access our services.

Message Frequency

Message frequency varies based on the nature of your interactions with us. You will not receive messages beyond what is reasonably necessary for customer care communications.

Message and Data Rates

Message and data rates may apply depending on your mobile carrier and service plan. You are responsible for any charges incurred from your carrier in connection with receiving text messages from us.

Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and will no longer receive text messages from us unless you opt in again.

No Sharing of Mobile Information

We will not share, sell, or transfer your mobile phone number or SMS opt-in consent data to any third parties or affiliates for their own marketing or promotional purposes. Information may only be shared with service providers acting on our behalf to deliver the messaging program (e.g., messaging platform providers), and such providers are contractually prohibited from using your information for their own purposes.

Supported Carriers

Our SMS program is supported on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

5. Community Applications and Background Checks

If you apply for residency at one of our manufactured housing communities, you acknowledge and agree that your application may be subject to a criminal background check and credit check. Each applicant pays a non-refundable application fee. Details regarding fees and the application process are provided at the time of application. The submission of an application does not guarantee approval or residency.

6. Disclaimer of Warranties

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ASPIRE COMMUNITIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the Site.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASPIRE COMMUNITIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless Aspire Communities, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

9. Third-Party Links

The Site may contain links to third-party websites or resources. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. Access to any third-party site is at your own risk and subject to the terms and conditions of use of such sites.

10. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Kent County, Michigan, and you consent to the personal jurisdiction and venue of such courts.

11. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aspire Communities regarding your use of the Site and supersede all prior and contemporaneous written or oral agreements, understandings, and representations.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page. Your continued use of the Site after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
